Introduction of electronic sick notes

In accordance with the amendment to the Sickness Insurance Act effective as of 1 January 2020, attending physicians will fulfil information obligations associated with employees’ temporary incapacity to work, in particular, the obligation to report its occurrence, termination or change or any breach of the temporary incapacity to work scheme, electronically. Only if there are demonstrably objective technical reasons, such as power failure or failure of the information system of the sickness insurance authority which prevents the form from being accepted, the information obligations may be fulfilled by completing the prescribed form in writing.

Physicians will have the opportunity to choose whether to issue electronic sick notes (“eNeschopenky”) through their own medical software or in the free web application on the ePortal of the Czech Social Security Administration. The introduction of electronic sick notes will facilitate the transfer of information between the Czech Social Security Administration or Regional Social Security Administrations, physicians, employees recognised as temporarily incapable of working and their employers. Although temporary incapacity to work is one of the major personal obstacles to work on the part of the employee about which the employee is obliged to inform the employer without undue delay, employers will now be able to request electronic notifications of temporary incapacity to work of their employees via the ePortal electronic service of the Czech Social Security Administration. After logging into the ePortal of the Czech Social Security Administration, the employer will see detailed information on the temporary incapacity to work of each employee and a summary of all employees incapable of working. After 14 days of the incapacity to work (and upon its termination), the employer must now provide the Czech Social Security Administration with an annex to the application for a benefit, indicating the account to which the employee’s wage or salary is paid (where the benefit is to be paid).
