Dear clients,

yesterday 23/7/2020 several  more relevant Extraordinary Measures were passed, namely:

Below we bring you a list of the most important obligations that arise for you from them.

Nationwide measures

Extraordinary Measure of Ministry of Health – with effect from 25 July 2020 to 26 July 2020 (from 00:00 to 23:59):

1. a ban on holding (indoor and outdoor) mass events with more than 1000 participants at the same time;

2. the obligation to wear respiratory protective equipment for indoor events with the participation of more than 100 people.

Extraordinary Measure of Ministry of Health - with effect from Monday 27 July 2020, until further notice:

1. a ban on holding mass events with more than 1000 participants at the same time (outdoor spaces), resp. 500 people in each sector with a maximum of 5 sectors (indoors);

2. the obligation to wear respiratory protective equipment for indoor events with the participation of more than 100 people.

Testing of Czech employees

Ministry of Health also specified in official press release that the obligation to test employees returning from countries, which are not considered low risk for these purposes (currently still Bulgaria, Portugal and Romania), about this obligation we informed you here. This obligation should not (accordingly to interpretation of Ministry of Health) apply to Czech employees (e.g. returning from leave from these countries), but only to foreign workers.

Measures RHS MSR

Extraordinary Measure No. 15/2020 of the Regional Hygiene Station of the Moravian-Silesian Region in Ostrava (details here) was repealed with effect from 6:00 today and replaced by two new Extraordinary Measures of RHS MSR with specific territorial effect:

1. Extraordinary Measure No. 16/2020 with effect in territories of the municipalities Bílovec, Bohumín, Český Těšín, Frenštát pod Radhoštěm, Frýdek - Místek, Frýdlant nad Ostravicí, Havířov, Hlučín, Jablunkov, Karviná, Kopřivnice, Kravaře, Nový Jičín, Odry, Opava, Orlová, Ostrava, Třinec, Vítkov and all municipalities for which they exercise extended powers;

2. Extraordinary Measure No. 17/2020 with effect in territories of the municipalities of Bruntál, Krnov, Rýmařov and all municipalities for which they exercise extended powers.

Obligations from both Extraordinary Measures (No. 16/2020 and No. 17/2020) – entire territory of Moravian-Silesian Region

At the moment, the obligation of all employers in the entire Moravian-Silesian Region to prevent entry into the workplace of cross-border workers who have not submitted once a 14-day medical certificate of passing the PCR test for SARS-CoV-2 with a negative result (max. 4 days old), is still in force - details here.

Extraordinary measures no longer work with the term of "worker end-user" and the testing obligation should therefore be limited to employees only (not to any third parties).

1. employers are, if possible, obliged to ensure in the production company, where employees meet each other when changing shifts, that previous or subsequent shifts do not meet (at the premises and workplaces of the given production company);

2. avoidance, if possible, of contact of employees with employees of individual production plants and workplaces of the given enterprise at a risk distance of less than 2 meters within one shift;

3. adoption of measures to minimize contact between staff for meals and clean-up in sanitary facilities so that if people do not come into contact with each other, especially if they do not carry out their work within a section, compartment, cell or establishment.

Obligations resulting from Extraordinary Measure No. 16/2020 - territories of the municipalities Bílovec, Bohumín, Český Těšín, Frenštát pod Radhoštěm, Frýdek - Místek, Frýdlant nad Ostravicí, Havířov, Hlučín, Jablunkov, Karviná, Kopřivnice, Kravaře, Nový Jičín, Odry, Opava, Orlová, Ostrava, Třinec, Vítkov and all municipalities for which they exercise extended powers:

1. ban of movement and residence of all persons without respiratory protective equipment (nose, mouth) - in all interiors of buildings outside the residence and in motor vehicles – with some exceptions, such as:

a) works that are included in a category other than the first in terms of heat load factor;

b) an employee while working in one place, if he works at a distance of at least 2 meters from another person;

2. a ban on the presence of the public in catering establishments from 00:00 to 08:00, including the outdoor premises of the establishment (with the exception of weddings and funerals);

3. restrictions on holding mass events - 100 people in one sector (max. Number of sectors is 5) for indoor spaces and ban of movement and residence of all persons without respiratory protective equipment, even at outdoor events.
